Terms and Conditions for Website Use and Car Hire Services

Welcome to EliteMotion Luxury Limited. These combined Terms and Conditions explain the rules that apply when you use our website, browse vehicle information, submit an enquiry, make a booking, rent a vehicle, or use our self-drive or chauffeur car hire services.
By using our website or booking a vehicle with us, you agree to these Terms and Conditions. If a signed rental agreement, invoice, quote, or written booking confirmation contains vehicle-specific terms, those vehicle-specific terms apply together with this page.
1. About EliteMotion Luxury
EliteMotion Luxury Limited provides premium car hire services in Nairobi and across Kenya. Our services include:
- Self-drive car hire
- Chauffeur-driven car hire
- Airport pickup and drop-off
- Home, office, and airport vehicle delivery
- Short-term, long-term, corporate, and event vehicle hire
Our vehicles may include SUVs, luxury sedans, 4x4 vehicles, safari vehicles, executive cars, vans, and other vehicle categories available on our website.
2. Definitions
In these Terms:
- "EliteMotion," "we," "us," or "our" means EliteMotion Luxury Limited.
- "Customer," "you," or "your" means the person or business booking or using our services.
- "Website" means elitemotionluxury.com and any page, form, booking flow, quotation flow, content, image, feature, or digital service provided through that domain.
- "Website Content" means text, images, vehicle listings, prices, specifications, graphics, videos, logos, layouts, code, guides, blog content, comparisons, FAQs, metadata, and other materials shown on the Website.
- "Vehicle" means any car, SUV, van, 4x4, or other motor vehicle hired from us.
- "Booking" means a request or confirmed reservation for a vehicle.
- "Quote" means an estimate or proposed price issued through the Website, email, social media, or another official channel before a booking is confirmed.
- "Rental Agreement" means the written or digital agreement signed or accepted before or during vehicle handover.
- "Rental Period" means the agreed period during which you hire the vehicle.
- "Chauffeur Service" means a vehicle hire service where we provide a driver.
- "Self-Drive Service" means a vehicle hire service where you or an approved driver drives the vehicle.
3. Use of Our Website
You agree to use our website only for lawful purposes and in a way that does not interfere with the website, our business, other customers, or any booking process.
The Website is provided so you can learn about EliteMotion, browse vehicle categories, compare vehicles, read guides, submit enquiries, request quotations, start a booking, access support information, and contact us through official channels.
You must not:
- Interfere with the website's normal operation
- Try to gain unauthorised access to our systems
- Copy, scrape, or misuse our content without permission
- Submit false, misleading, or fraudulent information
- Use the website to make fake or abusive bookings
- Use automated tools to extract vehicle data, pricing, images, or customer-facing content without permission
- Upload or send malicious code, spam, abusive content, or unlawful material through any form or communication channel
- Misrepresent your identity, authority to book, driver eligibility, payment status, or intended use of a vehicle
We may restrict access to the website or cancel bookings if we suspect misuse.
Website Content is provided to help customers understand our services and request bookings. It is general information only and does not guarantee that a specific vehicle, price, colour, trim, feature, delivery time, chauffeur arrangement, route, discount, or add-on is available until we confirm it directly.
If you submit a form, click a booking button, request a quote, or contact us through a digital channel, you are responsible for making sure the information you provide is accurate and complete. Incorrect information may delay confirmation, affect pricing, or lead to cancellation.
Our website may include links to third-party platforms such as maps, social media pages, messaging tools, payment providers, or external services. We are not responsible for third-party websites, platforms, policies, outages, or content.
You are responsible for your own internet connection, device, browser, settings, and access to the Website. We do not guarantee that the Website will always be available, uninterrupted, error-free, compatible with every device, or free from technical issues.
We may update, suspend, restrict, replace, or remove any Website feature, form, page, route, content, image, price display, quote flow, booking flow, or account-related feature at any time.
If the Website shows an obvious error, including a pricing error, vehicle mismatch, incorrect specification, duplicate listing, incorrect image, or unavailable vehicle, we may correct the error and are not required to honour the incorrect information.
You must not rely on Website Content as professional travel, legal, tax, financial, mechanical, safety, route, or regulatory advice. You are responsible for checking whether a vehicle, route, destination, travel plan, or service is suitable for your needs before confirming a booking.
Where the Website allows login, registration, saved vehicles, bookmarks, booking history, profile setup, or similar account features, you are responsible for keeping your access credentials secure and for activity carried out through your account or authenticated session.
If you submit reviews, messages, files, images, documents, route details, special requests, or other content through the Website or a related channel, you confirm that the content is accurate, lawful, and that you have the right to share it with us.
We may remove, ignore, decline, or refuse to act on any submission that is false, abusive, unlawful, discriminatory, threatening, misleading, spam, technically harmful, or unrelated to our services.
4. Bookings
You can request or make a booking through our website, email, social media, or any other official EliteMotion channel.
A booking is only confirmed when we verify availability and confirm the booking with you.
Vehicle availability may change due to:
- Prior bookings
- Vehicle maintenance
- Accidents or breakdowns
- Late returns by previous customers
- Events outside our control
Where a selected vehicle becomes unavailable, we may offer a similar or better replacement where possible.
5. Free Booking and Cancellation
Standard bookings are free of charge.
You may cancel your booking before vehicle handover without paying a cancellation fee, unless a special arrangement, corporate contract, long-term hire contract, or event booking states otherwise.
Once the vehicle has been handed over, cancellation will be treated as an early return. Charges may apply for the period already used or committed under the Rental Agreement.
6. Payment
Unless otherwise agreed, the full hire fee is paid after you have received, inspected, test-driven, and accepted the vehicle, and before departure or handover.
Rental prices will be confirmed before handover.
You agree to pay:
- The agreed rental price
- Any agreed chauffeur fees
- Any approved delivery or collection fees, where applicable
- Any extension charges
- Any late return charges
- Any fines, penalties, loss, damage, or costs caused by your use of the vehicle
All prices are stated in Kenya Shillings unless we state otherwise.
7. No Hidden Charges
We aim to provide clear and transparent pricing.
The price confirmed to you before rental is the price payable for the agreed rental service, unless:
- You extend the Rental Period
- You return the vehicle late
- The vehicle is damaged, lost, misused, or returned in poor condition
- You breach these Terms or the Rental Agreement
- You request extra services after confirmation
- Government fees, parking fees, tolls, fines, or penalties arise from your use of the vehicle
8. Security Deposit
For standard bookings, we may not require a booking deposit or security deposit.
However, for some vehicles, long-term rentals, corporate bookings, high-value vehicles, special events, or risk-based cases, we may request a refundable security deposit or card pre-authorisation.
Where a deposit is required, we will explain the amount and conditions before confirming the rental.
A deposit may be used to cover:
- Vehicle damage
- Missing items
- Late return charges
- Cleaning costs
- Traffic fines
- Parking penalties
- Fuel differences
- Breach of the Rental Agreement
Where a deposit is taken, it is applied to amounts due under the Rental Agreement and is not a limit on your liability.
Any balance will be refunded after the vehicle has been returned and checked.
9. Driver Eligibility
For self-drive rentals, every driver must be approved by EliteMotion before driving the vehicle.
You may be required to provide:
- A valid driving licence
- A national ID or passport
- Proof of residence or accommodation
- Any other reasonable verification documents
- For foreign drivers, an international driving permit or other accepted driving document may be required
We may refuse or cancel a self-drive booking if the driver does not meet our requirements.
10. Approved Drivers Only
Only drivers approved by EliteMotion may drive the vehicle.
You must not allow another person to drive the vehicle unless we have approved that person in writing or through an official communication channel. This applies even if the other person has a valid licence, is a family member, is an employee, is part of the travel group, or is paying for the booking.
You remain responsible for the vehicle during the Rental Period, even if another approved driver drives it.
If an unauthorised person drives, moves, parks, handles, or takes control of the vehicle, you remain responsible for all resulting loss, damage, delay, penalties, recovery costs, and business interruption.
11. Vehicle Handover and Inspection
Before the vehicle is handed over, you should inspect it carefully.
You should check:
- Exterior condition
- Interior condition
- Fuel level
- Tyres
- Spare tyre, jack, and tools where available
- Lights
- Mileage where applicable
- Registration documents
- Any visible damage
Any existing damage should be recorded before you take the vehicle.
By accepting the vehicle, you confirm that it is in good condition except for any recorded issues.
12. Fuel Policy
Fuel is not included in the rental price unless we clearly state otherwise.
The vehicle will be handed over with a certain fuel level. You are responsible for fuel used during the Rental Period.
You must return the vehicle with the same fuel level it had at handover.
If the vehicle is returned with less fuel, you may be charged for the difference.
We do not refund or compensate for extra fuel left in the vehicle unless we agree in writing.
13. Mileage Policy
Standard self-drive rentals may include unlimited mileage within Kenya, unless your quote or Rental Agreement states otherwise.
Unlimited mileage does not allow misuse of the vehicle.
You must still use the vehicle responsibly and only on roads or routes suitable for that vehicle.
Certain rentals may have mileage limits, especially for:
- Long-term rentals
- Corporate contracts
- Special vehicle categories
- Cross-county or remote-area trips
- Chauffeur-driven services
Any mileage limit will be confirmed before or during booking.
14. Use of the Vehicle
You must use the vehicle carefully, safely, and lawfully. You must obey all traffic laws and speed limits (the maximum speed allowed in Kenya is 110 km/h), and use the vehicle for personal use only unless we agree otherwise in writing.
You must follow the agreed route, destination, and use case disclosed at booking or handover. You must not materially change the route, destination, county, terrain, border area, overnight parking location, or use of the vehicle without written communication and approval from EliteMotion.
You must not:
- Use the vehicle for illegal activity
- Drive under the influence of alcohol, drugs, or any substance that affects driving
- Use the vehicle for racing, speed testing, stunts, or competitions
- Exceed speed limits, break traffic laws, or drive recklessly or dangerously
- Overload the vehicle
- Carry more passengers than legally allowed
- Tow another vehicle without written approval
- Carry dangerous, illegal, or prohibited goods
- Use the vehicle for public transport, ride-hailing, or to carry passengers for a fee, under any circumstances
- Drive outside Kenya without written approval
- Take the vehicle to unsafe or unsuitable terrain unless approved
- Change the agreed route, destination, or use of the vehicle without written communication and approval
- Tamper with the tracker, odometer, number plates, documents, or vehicle systems
- Sell, pledge, sublet, or transfer the vehicle to another person
15. Travel Within Kenya
Our vehicles may be used for travel within Kenya, subject to the Rental Agreement and the suitability of the vehicle for your route.
You should inform us of your intended destination or route, especially for long-distance trips, safari routes, remote areas, border towns, or rough-road travel.
We may restrict some vehicles from certain roads, regions, or routes for safety or maintenance reasons.
16. Travel Outside Kenya
You must not take the vehicle outside Kenya unless EliteMotion gives written permission before the trip.
Cross-border travel may require:
- Written approval
- Cross-border documents
- Additional fees
- A higher deposit
- Route approval
Taking the vehicle outside Kenya without approval is a serious breach of these Terms and the Rental Agreement.
17. Chauffeur Services
Where you book a chauffeur-driven vehicle, we will provide a driver for the agreed service.
You agree to treat the chauffeur respectfully and safely.
You must not ask the chauffeur to:
- Break traffic laws
- Drive in unsafe conditions
- Overload the vehicle
- Drive outside the agreed route without approval
- Carry illegal or dangerous items
- Work beyond agreed hours without approval
Extra hours, extra distance, overnight stays, parking, meals, accommodation, or out-of-town chauffeur costs may be charged where applicable and disclosed in advance where possible.
18. Delivery and Collection
We may deliver or collect vehicles at agreed locations such as your home, office, hotel, or airport.
Delivery and collection are subject to:
- Vehicle availability
- Location
- Time
- Traffic conditions
- Security and access conditions
- Prior agreement
You must be available at the agreed handover or return time.
If you delay handover or return, extra charges may apply.
19. Rental Period and Late Return
The Rental Period starts and ends at the agreed times in your booking or Rental Agreement.
You must return the vehicle on or before the agreed return time.
If you return the vehicle late without approval, there is a one-hour grace period. After that we charge a full day's rate for every day or part of a day until we receive the vehicle back.
If you return the vehicle before the end of the agreed Rental Period, the hire fee for the unused period is not refunded, unless we agree otherwise in writing.
Late return may also affect other customers' bookings. You are responsible for any reasonable losses caused by late return.
20. Extensions
You may request to extend your Rental Period. The request must be made in writing before the agreed return time, and the extension must be paid for in advance. If the vehicle is outside Nairobi, the request and payment must reach us no later than the driving time back to Nairobi before the return time; for example, 8 hours before if the vehicle is 8 hours away.
An extension is only valid when EliteMotion approves it.
If you keep the vehicle after the agreed return time without approval, this is unauthorised use and we may immobilise, stop, or recover the vehicle at your cost.
You must pay all approved extension charges.
21. Vehicle Condition on Return
You must return the vehicle:
- In the same condition as received, except for ordinary wear from approved use
- With the same fuel level as received
- With all keys, documents, tools, accessories, and equipment
- Not damaged, scratched, dented, stained, torn, misused, or mechanically compromised
- Clean and free from unreasonable dirt, mud, sand, food, spills, stains, smells, smoke, pet hair, or waste
- At the agreed location and time
We may inspect the vehicle after return.
If damage, missing items, heavy cleaning needs, fuel shortages, late return, route misuse, or other issues are found, you may be charged.
Returning the vehicle late, damaged, dirty, incomplete, or at the wrong location may affect other bookings. You are responsible for the direct costs and losses caused by that failure, including continued hire under section 23 where the vehicle cannot be used for new bookings.
22. Cleaning
Normal use is expected.
However, you may be charged cleaning fees if the vehicle is returned with:
- Heavy mud
- Food or drink spills
- Smoke smell
- Pet hair
- Stains
- Bad odours
- Excess sand or dust
- Any other unusual dirt or mess
Smoking inside the vehicle is not allowed unless we give written approval.
23. Damage, Loss, and Theft
You are responsible for any loss, theft, or damage caused by:
- Negligence
- Reckless driving
- Careless use
- Breach of these Terms
- Breach of the Rental Agreement
- Unapproved drivers
- Unapproved routes
- Driving under the influence
- Failure to secure the vehicle
- Failure to report an incident immediately
- Misuse of the vehicle
You are responsible for all types of damage to the vehicle during the Rental Period unless EliteMotion confirms otherwise in writing. This includes, without limitation:
- Tyre bursts, tyre cuts, punctures, sidewall damage, wheel damage, rim damage, and wheel alignment issues
- Scratches, dents, paint damage, body damage, broken lights, broken mirrors, cracked glass, and windscreen damage
- Interior stains, burns, tears, broken controls, missing accessories, and upholstery damage
- Underbody damage, suspension damage, damage from rough roads, and damage caused by unsuitable terrain
- Damage caused by wrong fuel, overheating, warning lights being ignored, negligent driving, overloading, or continued driving after a fault appears
- Loss or damage to keys, tools, documents, number plates, tracking devices, or issued accessories
Tyre punctures are a normal risk when driving and can happen unexpectedly. Because the client controls where and how the vehicle is driven, puncture repairs and related tyre damage are the client's responsibility during the Rental Period. Insurance policies in Kenya do not cover tyre punctures or tyre damage. If you get a puncture, stop somewhere safe and contact EliteMotion immediately before arranging any repair. Do not repair or replace a tyre without our written approval. The client is also responsible for related call-out, towing, or recovery costs unless EliteMotion confirms otherwise in writing.
You must report any accident, theft, damage, or mechanical issue to EliteMotion immediately.
You must also cooperate with police and any authorised investigation where required.
Continued hire. Where you are responsible for damage, the chargeable hire period continues beyond the agreed return date, at the daily rate in your Rental Agreement, until the vehicle is restored to a safe, roadworthy, and rentable condition and is available for further hire. Physical return, towing, insurer collection, or delivery to a garage does not by itself end this period. Prepaid days covering the same period are credited, and we do not charge loss of use separately for the same days. The maximum is 360 additional chargeable days per incident. Continued hire is charged in addition to repair, recovery, cleaning, replacement, administrative, fine, penalty, and other applicable costs.
Contractual excess. For each incident for which you are responsible, you pay a contractual excess of 5% of the vehicle's insured value on the incident date, as shown in our insurance policy schedule. The excess is your first portion of the established damage loss and is limited to that loss. It is credited against everything you owe for that incident and is never charged on top of a repair cost you have already paid in full. Your liability is not limited to the excess.
Diminished value. Where an incident involves structural or chassis damage, or major accident repairs likely to affect resale value, we may obtain a written diminished-value report from the assessor we ordinarily use for insurance assessments. You pay the diminished value stated in the report and the reasonable, documented cost of the report. Diminished value is not charged as a fixed percentage or for minor damage.
No replacement vehicle. We are not required to provide a replacement vehicle after an accident, damage, or breakdown, and the absence of a replacement does not suspend continued hire. Any later hire of another vehicle is a separate booking with its own charges.
Payment. Amounts due for damage, continued hire, and related costs are payable within 7 days of our itemised demand unless the demand states another date. The full rules are in the Rental Agreement.
24. Accidents and Emergencies
If the vehicle is involved in an accident, you must:
- Stop safely.
- Check that everyone is safe.
- Contact emergency services where needed.
- Notify EliteMotion immediately.
- Report the matter to the police where required.
- Do not admit liability without proper advice.
- Take reasonable photos and details of the scene where safe.
- Get the other party's details where applicable.
- Follow our instructions and cooperate with any required investigation.
You must not abandon the vehicle unless required for safety.
25. Breakdown and Roadside Support
If the vehicle develops a mechanical problem, contact EliteMotion immediately.
Do not continue driving if doing so may worsen the problem or create a safety risk.
Where the problem is not caused by misuse, we may arrange support, repair, or recovery. We are not obliged to provide a replacement vehicle.
If the breakdown is caused by misuse, negligence, wrong fuel, unsafe driving, or breach of these Terms, you may be responsible for repair, towing, recovery, replacement, and related costs.
26. Traffic Fines, Parking Fees, and Tolls
You are responsible for all traffic fines, parking fees, tolls, penalties, towing charges, clamping charges, and related costs incurred during the Rental Period.
If we pay any fine or penalty on your behalf, you must reimburse us.
We may also charge reasonable administration costs for handling fines, penalties, or official notices.
27. Personal Belongings
You are responsible for your personal belongings in the vehicle.
EliteMotion is not responsible for loss, theft, or damage to personal items left in the vehicle, unless caused by our proven negligence.
You should remove all personal items before returning the vehicle.
28. Vehicle Tracking and Security
Our vehicles may be fitted with tracking, security, or monitoring systems.
These systems may be used to:
- Protect the vehicle
- Support recovery in case of theft
- Monitor vehicle location
- Confirm route or location where necessary
- Manage safety, maintenance, and misuse issues
- Support legal claims
You must not remove, disable, tamper with, or interfere with any tracking or security device.
If the vehicle is driven by an unapproved person, driven outside the agreed route, or used in breach of traffic laws or these Terms, we may disable the vehicle and repossess it without refund.
When the vehicle is not being driven, it must be parked in a locked, secure compound or another secure parking location approved by EliteMotion. You must not leave the vehicle unattended in an unsafe, open, isolated, unguarded, or high-risk area where theft, vandalism, towing, clamping, or damage is more likely.
29. Customer Information and Privacy
We may collect and use your information to:
- Process bookings
- Verify your identity
- Confirm driver eligibility
- Communicate with you
- Deliver and collect vehicles
- Manage payments
- Handle accidents, claims, fines, or disputes
- Improve our services
- Meet legal or regulatory requirements
Your information may be shared with service providers, law enforcement, regulators, payment providers, or other relevant parties where necessary.
We will handle your personal information in line with applicable data protection laws.
30. Website Content
All Website Content, including text, images, logos, vehicle listings, pricing displays, specifications, comparisons, FAQs, guides, design, layout, and branding, belongs to EliteMotion or its content providers unless stated otherwise.
You may view Website Content for personal or internal business use when considering EliteMotion services.
You may not copy, reproduce, distribute, republish, scrape, frame, mirror, sell, train a commercial dataset on, or use our Website Content for commercial purposes without written permission.
Nothing on the Website transfers ownership of any intellectual property, brand name, design, logo, image, copy, vehicle listing, database, or Website Content to you.
You may link to public pages of the Website in a fair and lawful way, provided the link does not misrepresent your relationship with EliteMotion, imply endorsement, or damage our reputation.
31. Vehicle Images and Descriptions
We try to keep vehicle images, prices, specifications, and descriptions accurate.
However, actual vehicles may vary depending on availability, model year, colour, trim, accessories, or condition.
Images on the website are for identification and marketing purposes.
We may provide a similar vehicle if the selected vehicle is unavailable.
Website prices, discounts, packages, and daily rates are subject to confirmation. A Website display, calculator, filter, comparison table, or automated output is not a final invoice unless EliteMotion confirms it.
32. Availability and Service Changes
We may update, change, suspend, or stop any part of our services or website at any time.
We may also change vehicle prices, availability, categories, or features without prior notice.
Confirmed bookings will be handled based on the terms agreed at confirmation, unless changes are required due to safety, legal, operational, or availability reasons.
The Website may be unavailable or inaccurate during maintenance, hosting interruptions, network outages, security incidents, third-party service failures, updates, or technical errors. We may correct Website errors without prior notice.
Submitting an online enquiry, quote request, booking form, login form, profile form, or other Website form does not by itself create a confirmed booking or guarantee service. Confirmation requires acceptance by EliteMotion through an official communication or booking record.
33. Limitation of Liability
To the fullest extent allowed by law, EliteMotion is not liable for indirect, incidental, special, or consequential losses, including:
- Loss of profit
- Loss of business
- Missed meetings
- Missed flights
- Travel delays
- Loss of opportunity
- Personal inconvenience
Our liability for any claim related to a rental is limited to the amount paid for the affected rental service, unless the law does not allow such limitation.
Nothing in these Terms limits liability where it cannot legally be limited.
34. Indemnity
You agree to indemnify and hold EliteMotion harmless from claims, losses, costs, damages, penalties, and expenses arising from:
- Your breach of these Terms
- Your breach of the Rental Agreement
- Your misuse of the vehicle
- Your unlawful conduct
- Any unauthorised driver
- Any fines, penalties, damage, loss, or injury caused during your Rental Period
35. Refusal or Cancellation of Service
We may refuse, suspend, or cancel a booking or rental if:
- You provide false information
- You fail verification
- You fail to pay agreed charges
- You breach these Terms
- You misuse a vehicle
- You behave abusively or unlawfully
- The vehicle becomes unavailable
- Providing the service would create a safety, legal, financial, or operational risk
Where cancellation is caused by our inability to provide the service, we may offer a replacement vehicle, rescheduling, or refund of any amount paid for the unused service.
36. Force Majeure
EliteMotion is not liable for delay or failure to perform caused by events beyond our reasonable control, including:
- Accidents
- Vehicle breakdowns
- Severe weather
- Floods
- Road closures
- Traffic disruptions
- Strikes
- Government action
- Civil unrest
- Power or network failure
- Natural disasters
- Other events outside our control
37. Governing Law
These Terms are governed by the laws of Kenya.
Any dispute will first be handled through good-faith discussion.
If the dispute cannot be resolved, it may be referred to the courts or other lawful dispute resolution forums in Kenya.
38. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on our website with a new "Last updated" date.
By continuing to use our website or services after changes are posted, you accept the updated Terms.

40. Online and Remote Agreements
Bookings may be requested or confirmed through the website, email, social media, or other official EliteMotion channels. Where a booking is agreed remotely, the confirmed quote, invoice, rental agreement, email confirmation, or other written confirmation may form part of the agreement between you and EliteMotion.
You should read the confirmed price, dates, vehicle, pickup point, return point, driver details, route assumptions, fuel arrangement, chauffeur arrangement, and any special conditions before accepting the booking. If anything is incorrect, you must tell us before vehicle handover.
41. Acceptance of These Terms
You accept these Terms when you use the website, submit a booking request, confirm a quote, pay any amount toward a booking, sign or accept a rental agreement, receive a vehicle, or continue using a vehicle after handover.
If you are booking for a company, guest, director, employee, wedding party, family member, or travel group, you confirm that you are authorised to share their information and accept booking conditions on their behalf.
